PRODUCT WARRANTY

WHICH PRODUCTS ARE COVERED?

Our 6-month warranty (the "Warranty") extends to bags and accessories (our “Products”) manufactured by BirdyBag. and purchased directly from our official website (https://www.birdybag.co). This excludes any products under clearance sale when the order is placed.

The warranty period starts from the day you place the order. It does not cover your product if you use it in a manner that is incompatible with the intended design and purpose.

WHAT IS THE EFFECTIVE DATE? CAN IT BE TRANSFERRED?

This warranty is effective on all covered products purchased from 1st January 2021 onwards. Products purchased prior to this date are not covered.

It extends only to the original purchaser of the product. All warranties are not transferable.

WHAT IS NOT COVERED?

Scratches, dents, rips, tears, loose threads, edge paint peelings, stains or discolorations that occur through normal use of the product and do not impair the functionality of the product.

Damage that occurs from improper maintenance, washing, or cleaning as well as damages that are the results of attempted self-repair.

Damage that is caused by exposure to extreme temperatures, solvents, acids, or water.

Any product sold by an authorized third-party vendor, retailer, or website that is not BirdyBag. (https://birdybag.co). The same applies on any product sold by an unauthorized party such as second-hand dealers or resellers.

WHAT HAPPENS IN THE EVENT OF A DEFECT?

In the event of a defect, a repaired or replacement product will be provided at the option of BirdyBag., subject to the fulfillment of your responsibilities below. Replacement product may be manufactured in a different batch than the original item you purchased. Therefore, slight color difference may occur, especially on natural materials such as leather.

As the warranty holder, you must provide us with proof of the original date of purchase. BirdyBag. will investigate the cause of the defect and come up with a solution, either repair or replacement. Replaced or repaired product is subject to the same warranty as the original product (i.e. same last day of warranty coverage as the original purchase).

* BirdyBag reserves the right of final decision on the claim of warranty.

DISCLAIMER OF WARRANTY

EXCEPT FOR THE EXPRESS WARRANTIES SET FORTH ON THE WARRANTY POLICY, BIRDYBAG. MAKES NO REPRESENTATIONS AND GRANTS NO EXPRESS OR IMPLIED WARRANTIES, EITHER IN FACT OR BY OPERATION OF LAW, BY STATUTE OR OTHERWISE, UNDER THIS AGREEMENT. BIRDYBAG. SPECIFICALLY DISCLAIMS ANY OTHER WRITTEN OR ORAL WARRANTIES, WHETHER EXPRESS OR IMPLIED.

LIMITATION ON LIABILITY

IN NO EVENT SHALL BIRDYBAG BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR SPECIAL DAMAGES ARISING OUT OF THE USE OF THE PRODUCT, INCLUDING, WITHOUT LIMITATION, PROPERTY DAMAGE, LOSS OF VALUE OF THE PRODUCT OR ANY THIRD PARTY PRODUCTS THAT ARE USED IN OR WITH THE PRODUCT, EVEN IF BIRDYBAG. HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. BIRDYBAG HAS NO LIABILITY FOR ANY DAMAGE TO CONSUMER ELECTRONICS DEVICES OR OTHER PERSONAL PROPERTY THAT ARE IN OR CONNECTED TO THE PRODUCTS, INCLUDING, WITHOUT LIMITATION, LAPTOP COMPUTERS, TABLETS, SMARTPHONES, OR OTHER DEVICES. BIRDYBAG HAS NO LIABILITY FOR ANY LOSS OF DATA CONTAINED IN THE DEVICES.

NOTWITHSTANDING ANY DAMAGES THAT YOU MIGHT INCUR FOR ANY REASON WHATSOEVER, THE ENTIRE LIABILITY OF BIRDYBAG SHALL BE LIMITED TO THE ACTUAL AMOUNT PAID BY YOU FOR THE PRODUCT. SOME COUNTRIES, STATES AND/OR JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES. IN THAT CASE, THE ABOVE LIMITATIONS OR EXCLUSIONS MAY NOT APPLY TO YOU.
